Terms & Conditions: These rules are designed to protect Vision Technology Management (hereinafter referred to as Vision), its employees and its users. They are also provided to make your use of Vision a positive and secure experience for everyone involved. We believe that our customers' freedom and privacy are of paramount importance and that these rules serve to secure that freedom and privacy. Becoming a Vision user constitutes an agreement to abide by these rules. All references to Vision in the Service Agreement Terms and Operational Rules include the system and its employees. 1. Vision is not to be used by customers or users for any illegal activities or other purposes prohibited by law. 2. Regarding minors, those under 18 years of age: Please have your parent or guardian fill out all necessary account registration forms and enclose appropriate payment. We cannot accept payment from those under the age of 18. If you are the guardian or parent of a minor who is requesting access, read these pages in their entirety. Some material accessible from this system may concern adult themes or subject matter. 3. Vision services may be used only for lawful purposes. Transmission or solicitation for reception of material which violates US Federal or South Carolina State Law, or State Law of the state you reside in, or Local Law of the township you reside is prohibited. This includes material that is threatening, legally obscene, libelous, or violates trade-secret, patent, or copyright protections. 4. Vision services may not be used for the public display of what is determined to be pornography by the employees at Vision. 5. You agree to indemnify and hold harmless Vision and its owners from all claims which are a result of your usage, without limitation. 6. You agree that the security of your account, including the password, is your responsibility and that all use which emanates from your account will be considered to be undertaken by you unless it can be shown to have been an unauthorized intrusion. You agree to notify Vision immediately if you believe that your account has been or is being compromised in any manner. 7. Material passed via Vision to their networks must comply with the other network's rules and regulations. 8. Vision makes no warranties or representations of any kind, whether expressed or implied, for the services which are being provided. Vision explicitly disclaim any warranty of merchantability or fitness for any purpose whatsoever. Vision will not be responsible for any damage you suffer as a result of using Vision services regardless of cause, including but not limited to loss of data resulting from delays, improper or incomplete delivery of information, service interruptions caused by Vision own negligence, possible malicious computer viruses and/or Trojan horses. 9. Vision has no control whatsoever over the information passing through its system. Use of any information obtained through Vision is at your own risk. Vision specifically denies any responsibility for the accuracy or quality of information obtained through its services. 10. Notwithstanding the above, you agree that should we be found liable in a court of law for any action or lack of action related to your use of Vision services, our liability is limited to the unused portion of your subscription fee. 11. You agree not to abuse the system and its resources, including any quota on disk usage which may be imposed and policies on the use of resources (such as USENET) which reach beyond this system. You agree not to attempt to violate the security of this system's authentication and accounting procedures. 12. Vision reserves the right to change these terms and conditions at any time, as well as the services offered. Posting of the new terms and conditions or service changes on the system in a conspicuous place shall constitute proper notice. 13. Any customer or user can upload or download material on the Vision system is subject to the following conditions. Copyrighted material can only be placed on Vision systems with the author's permission. The customer or users cannot download copyrighted material without express permission from the author. The customer or user assumes all risks in determining whether such material is copyrighted or public domain. 14. The customer or user shall obey Vision acceptable use policies. Although the Vision system is on a commercial exchange, the customer or user assumes all the risks of transferring prohibited material across restrictive networks and transgressing their acceptable use policies. Otherwise, the Internet can be used for business purposes in almost all cases. Implicitly prohibited activities include the unlicensed international export of various materials. The customer or user is responsible for learning these policies, but Vision employees will be happy to assist. 15. The customer or user will not attempt to undermine, hinder, damage, or disrupt the hardware, software, or security of the Vision system or the Internet and its systems. 16. Vision will maintain the strict privacy of all customer and user accounts except in the case of court order. Vision, however, does not guarantee the safety, accuracy, or content of any materials or information on the Internet or any materials the customer transfers or receives on the Internet. The customer or user acknowledges that all information obtained on the Internet or Vision is provided without warranty of any kind and that the customer's or user's risk of acting on such information is entirely his/her own. 17. The customer or user is prohibited from soliciting Vision customers or users to become customers of other competitive information services. 18. Vision reserves the right to modify the rules at any time by publishing such modifications over the service and sending notices to each customer and user. 19. Users may not use Vision FTP service or it analogues to attempt to transfer any files not specifically permitted, or access hosts which do not permit anonymous transfers (unless the transfer is to or from an account you are authorized to access on the remote host). 20. Any attempt to cause traffic levels to Vision or other networks to rise without reason or for malicious purpose (e.g., transmitting large files to people for malicious purposes, "mail bombing", transmissions intended to raise the cost of another network provider's access through excessive traffic levels, etc). is prohibited. 21. The customer or user agrees to waive all claims against Vision, legal or otherwise incurred through the use of the Vision system or the Internet and its systems. The customer also agrees to indemnify and hold harmless Vision from any claims and expenses related to the customer's or user's violation of the Operational Rules or the Service Agreement Terms. 22. The customer agrees not to send any unsolicited e-mail (commonly called SPAM) using Vision servers and/or referencing Vision, your domain or your clients domains. Aside from the intrusive nature of Spamming, our servers can be subject to blocking for violating Universal Spam Policies. If you have any questions please do not hesitate to contact us. 23. POP e-mail accounts allow users to retrieve e-mail from our server and view it on their computer using the mail program of your choice. This account is for Web Presence convenience (i.e. Autoresponders, forms to e-mail, etc.) and is not to be used for bulk mailing or relaying. 24. Violation of any of the terms and conditions of service may result in the cancellation of your subscription and the forfeiture of the remainder of your pre-paid fees. Serious violations may result in civil and/or criminal prosecution. 25. Vision operates under the laws of the State of South Carolina, and the United States of America.
